As a small, local company our primary goal is to ensure you have a delightful trip to Atlantic Canada. With that in mind, please know we have taken great care to ensure every detail has been considered for your trip. We have listened to your needs and planned accordingly to ensure the trip we have designed with you provides a lifetime of wonderful memories.

Please note our Terms & Conditions as we go forward in creating the most amazing trip for you. We ask that you please read these conditions carefully and let us know if you have any questions. We do ask that you sign the attached to acknowledge that you accept the conditions we have outlined.

Payment Conditions

Your reservation will be confirmed upon payment of a non-refundable deposit of $500 (CDN) per person, with the exception of trips including Fogo Island Inn, which requires a non-refundable deposit of 50% of total trip price.

Payments for deposit and/or final payment are accepted by credit card (Visa, Mastercard, American Express), bank draft, wire transfer, and electronic funds transfer.

The remaining balance is due 45 days or more prior to departure.

Please note: Credit card information should never be transmitted via email, but rather via telephone. Maxxim Vacations process the charges in Canadian funds and your credit card company will exchange this to your home country currency at the exchange rate applicable on the day the bank processes the charge which may slightly vary from the quote we have provided in Canadian dollars.

If you wish to pay by credit card, you will need to complete and return the credit card authorization form.

Changes and Cancellations

If, after your reservation has been confirmed, you wish to alter the arrangements (property room category, vehicle category, change of property), we will do our best to satisfy your requirements and if there is a difference in price of the revised vacation itinerary, we will advise you of the revised price.

As we work with a variety of small businesses that rely on our partnerships, once we secure our reservations with these businesses, we do our best to honour our commitments.  We put our heart and souls into all that we do each day to ensure you have wonderful experiences, to represent our culture of hospitality, to provide meaningful employment and see the communities in which we operate have opportunities to see businesses grow.

With these considerations in mind, our vacation packages are non-refundable. We appreciate that unforeseen circumstances can cause a disruption in travel plans and recommend the purchase of travel insurance.

Special Care and Assistance

All clients requiring special care, assistance, attention or treatment must advise Maxxim Vacations of any and all specific needs at the time of booking, in order to advise suppliers of requirements. We will do our utmost to ensure your needs are met but please note not all accommodations are properly equipped to handle consumers requiring special care and assistance.

Air Arrangements

Once you have confirmed your air arrangements, please forward your details to us to update your travel arrangements accordingly. Maxxim Vacations is not responsible if an airline cancels, reschedules, or delays a flight for any reason. If you miss your departure flight or connection, it is your responsibility to work with the airline on which you are ticketed to reach your destination. No refunds will be provided by Maxxim Vacations for portions of trips missed due to canceled, rescheduled or delayed flights after airport check-in, nor is Maxxim Vacations responsible for any additional expenses you may incur prior to joining your trip if you miss your departure flight or flight connection.

Car Rentals

Rental charges are based on a 24-hour clock and the drop-off time must coincide with the pick-up time to minimize additional charges. Your vacation includes concession fees; however, insurance and gas are not included. Car rental companies require a major credit card upon pick up. Additional drivers and minimum age requirements resulting in extra charges are to be paid locally.

Weather

Safety is our primary concern. Please note that weather may impact some tours and it may be necessary to modify the itinerary accordingly due to poor weather conditions. For tours, if this occurs we will do our best to reschedule the tour or we will endeavor to add an additional tour or activity to replace the cancelled activity. If it occurs that the modification is less expensive than the original activity, we will refund the difference in cost. If the alternative is more expensive, we will apprise you of the cost difference before proceeding, to ensure the additional costs are acceptable to you. If a tour is cancelled and there is not a suitable alternative, we will refund you the cost of the tour.

Participation in activities, tours and transportation is not mandatory and purely voluntary. We strongly recommend travel insurance to help protect against unforeseen circumstances. If additional transportation or accommodation is necessitated by weather, you, the client are responsible for the additional costs.

Proof of Citizenship and Travel Documents

It is your responsibility, as our client, to obtain all documents required by all relevant government authorities and associated costs for such documents. A valid Canadian passport is recommended for travel outside Canada, including St. Pierre et Miquelon, as this is the most assured identification both for entry into another country and re-entry to Canada.  Likewise, a valid U.S. or other passport is required for travel to Canada.  All documents presented must be originals. Consumers failing to provide the required documents may be denied boarding privileges by the carrier or relevant authorities, without further recourse or the possibility of a refund. No refund or replacement will be given for lost or stolen travel documents. It is the client’s sole responsibility to ensure the immigration eligibility of all travelling party members for any countries included in this vacation (Canada and France).

Responsibility and Acknowledgement of Risk

Maxxim Vacations makes arrangements with suppliers who provide travel services and activities outlined in your itinerary, but we act as agents for the various independent suppliers. Such services are subject to the terms and conditions of these suppliers, as well as the ones we have outlined.  Although we try our best to choose the most reputable suppliers, we cannot be responsible for their acts or omissions, and as such, maintain no control over the personnel, equipment, operations or goods of the said supplier. The travel services and other services provided are subject to the conditions imposed by these suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements.

Maxxim Vacations cannot be held liable for any delay, loss of personal belongings, injury, accident, mortality, damage, inconvenience, loss of enjoyment, upset, disappointment or frustration, either mental or physical, that is to say, an unforeseeable event such as, but not limited to, the following:

– any unjustifiable or negligent act or omission on behalf of a service provider or an employee thereof;

-any illness, theft, mechanical breakdown, poor weather conditions, supplier bankruptcy and insolvency, overbooking or downgrading of services, mechanical failure of transportation or for failure of any transportation to arrive or depart on time, or other factors over which no reasonable control can be exercised by either Maxxim Vacations.

Force Majeure

Maxxim Vacations cannot be held liable if it becomes impossible to deliver services by either party due to war, government regulations, disaster, strikes, civil disorder, curtailment of transportation facilities or other emergencies.

Jurisdiction

The Terms and Conditions we have outlined form a contract that shall be governed by and construed in accordance with Newfoundland and Labrador Provincial law, and the laws of Canada applicable therein.   Any disputes shall be resolved in the jurisdiction of the courts located in Newfoundland and Labrador, Canada, in all disputes arising out of or relating to the Terms and Conditions and your relationship with Maxxim Vacations.
